Notes
On July 1, the Joint Committee on Environment, Natural Resources and Agriculture released H.3945, a redraft of H.771, the bag bill seeking to ban plastic bags and place a 10-cent fee on paper bags. The bill allows for plastic bags thicker than 4mils to be considered reusable and does give retailers explicit permission to charge for paper bags but does not require it. The bill includes local preemption language that is different from the standard text usually in bag legislation. The bill was referred to the House Ways & Means Committee for further review and there are several remaining steps on the way to passage where the language could still be changed.

Paper bags with or without handles provided at the point of sale to a customer of an Establishment for use to transport or carry away purchases, such as merchandise, goods or food, etc. and that (1) are one hundred percent (100%) recyclable, and (2) contain a minimum of forty percent (40%) postconsumer recycled paper content, and (3) have all the following information printed in a visible manner on the outside of the bag: the word “recyclable,” the name and country of the manufacturer, and the percentage of postconsumer recycled paper content.

A bag specifically designed and manufactured for long term, multiple reuses made of cloth, fabric or other durable, washable materials.

Any business selling goods, articles, food or personal services to the public, including public eating establishments and take-out restaurants.
